These Health and Medical Terms form part of our Terms and Conditions agreement, together with our Reservation and Payment Terms.
INTERPRETATION & DEFINITION
In this agreement the meaning of the following terms is defined in our Terms and Conditions agreement: Retreat/s, Service/s, Reservation, Health Form, Caya Shobo Representatives, Reservation.
While we cannot eliminate all risks involved with travel or participation in our Services, here are some of the key points that, upon making a Reservation to participate in our Services, you understand, acknowledge and agree to:
- Travel and participation in our Services carries risks, including risks associated with:
- ingestion of ayahuasca and/or other plants which have in the past been associated with injury or death,
- change of dietary habits such as fasting which may cause physical debilitation, injury, or illness,
- being in a wilderness environment that may cause mental or emotional discomfort, or exposure to serious infection or disease, injury or death,
- adherence to the recommendations or information we provide which pertains to your physical, mental, emotional or spiritual well-being.
- Your participation in our Services, which may involve ingestion of plant preparations, including ayahuasca, may be physically, mentally or emotionally demanding and may cause dizziness, nausea, vomiting, fatigue or other upsets. You may feel worse during or after participation in our Services, and you accept full responsibility for any and all manifestations of physical, mental or emotional change, disorientation or disturbance that may occur.
- There may be medical contraindications to ingesting ayahuasca or other plant preparations offered by Caya Shobo, and that the list of substances contraindicated includes, but is not limited to SSRIs, SNRIs, pain medications, cold and sinus medications, decongestants, nasal sprays, hay fever medications, diet pills, heart medications, amphetamines, MDMA, e-cigarettes and other drugs and substances.
- Subject to points 5) and 6) below, you understand that our Services, guidance and recommendations are aimed at assisting you to make changes in your life and achieve your goals. You hereby give your informed consent to us and any of our Representatives to assist you in achieving such goals.
- Notwithstanding point 4) above, our Services are not intended to diagnose, treat or cure any medical or mental health conditions, and do not constitute professional medical or mental health care, nor are they a substitute for such care. You agree not to use our Services in place of any form of therapy prescribed or instructed by your professional medical or mental health advisers.
- Our Representatives are not acting as professional medical or mental health advisers, but they may offer guidance, recommendations or information before, during or after your participation in our Services to ensure your safety and to assist you in making changes in your life. You acknowledge that this does not constitute, or act as a substitute for professional advice or medical health care.
- You agree to full disclosure in writing before participation in our Services (by filling in our Health Form and communicating any updates to us in writing), of any mental or physical health conditions, any drugs, medications or supplements you have taken in the past 12 months, any disability, pregnancy, or other physical and/or mental condition, or any recent changes to these which may affect your participation in our Services, including any instructions you are following from professional medical advisers. You assume all responsibility for any consequences for incomplete or false information in your Health Form or other communication with us.
- We reserve the right to determine if you are eligible to participate in our Services. If we believe your health or safety is at risk or if you have failed to disclose any medical or health condition or reason that could potentially impact your ability to participate in our Services, we may refuse to accept your participation in all or part of our Services without refund or compensation.
- You are responsible to inform your medical adviser/s of your intention to participate in our Services, and of any recommendations we have made about how you should prepare for safe participation in our Services. You accept that you will remain at all times fully responsible for your own health and well-being, and that should you have any concerns regarding your diet, medication or any health condition that you will seek the advice of your qualified medical adviser/s.
- You agree to comply fully with any and all health and safety policies we introduce, and subject to all other points in this agreement, you agree to adhere to any and all preparation and safety instructions we specify, including abstinence from contraindicated substances, supplements or dietary ingredients. You understand that certain dietary restrictions are required when preparing to participate in our Services.
- Our Representatives may describe potential benefits of our Services, but you accept that we make no claim or promises about the curing of illness of any kind, or about the nature of any spiritual experience, which you understand is entirely personal. You understand that to the extent that any guidance or information you receive from us regarding our Services involves discussion of health, well-being, spirituality, relationships, career, business or life, that we are not promising outcomes, including achieving certain states of consciousness or spirituality.
- You agree to cover all costs for any extra services or care that you may require during your participation in our Services, including any special care, medical attention or evacuation costs.
