TERMS & CONDITIONS

Caya Shobo provides traditional Shipibo therapeutic retreats and related services. These Terms and Conditions govern your reservation, preparation and participation in our retreats and other services. 

Please read these Terms and Conditions carefully and do not hesitate to contact us at team@cayashobo.com if you have any questions. 

Terms and Conditions Caya Shobo SAC

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of another person (“you”, “your”) and Caya Shobo SAC, doing business as Caya Shobo (“Caya Shobo”, “we”, “us”, or “our”), concerning your use of our retreats or other services. Your reservation, preparation for, and participation in our retreats and other services is subject to these complete Terms and Conditions.

These Terms and Conditions together with any documents they expressly incorporate by reference (collectively “Terms and Conditions”), (including these Terms and Conditions, our Reservation and Payment Terms, Medical Terms, Privacy Policy and our Website Terms of Use), represent the entire agreement between you and us and apply to the exclusion of any other terms or of any previous course of dealing. 

INTERPRETATION & DEFINITION 

 In this agreement and in our Reservation and Payment Terms and in our Medical Terms, unless otherwise specified, the following expressions refer to the following meanings: 

Retreat – Our Shipibo retreats are detailed on our website (cayashobo.com), and include a variety of therapeutic treatments, Dieta practice, discussions and other activities, accommodation, meals and other services. 

Dieta – a Shipibo therapeutic practice described in detail on our website (cayashobo.com), involving the periodic ingestion of plants or plant preparations, and adhering to certain dietary restrictions, meditation and lifestyle changes over different periods of time, with the aim of supporting you in making changes in your life.

Caya Shobo Representatives – our retreat facilitators, staff, volunteers, maestros, teachers, directors, owners, consultants, affiliate therapists, counselors, coaches, owners or any other representatives of Caya Shobo (“Caya Shobo Representatives").

Support Service – Dieta, ceremony, therapeutic treatment, song treatment, plant remedy, educational conference,  facilitator discussion, guidance session, coaching session, integration session or other support program or activity offered by Caya Shobo, or facilitated by Caya Shobo Representatives. 

Services – our Retreats and/or Support Services.

Reservation Email – email we send when you reserve to participate in our Services.

Reservation –  The reservation made by you with Caya Shobo for participating in our Services, as set out in the Reservation Email sent to you upon booking.

Commencement Date – the start date for the Service in which you have made your Reservation, as described on our website (cayashobo.com).

Medical Questionnaire – the medical questionnaire produced by Caya Shobo to be completed by you when and upon making a reservation with us.

Confirmation Email – the email we send to you confirming that you have been cleared and approved to participate in one of our Services.

Deposit – a deposit payment of 40% is required to reserve a place at one of our Services.

The Center – The land and facilities owned by Caya Shobo where our Retreats and some of our Support Services are conducted, located at Lote 12, Comunidad el Varillal, Carretera Iquitos-Nauta 14km, Iquitos, Peru.

Wording importing the singular meaning includes the plural meaning and vice versa.

The headings in these Terms and Conditions are for convenience only and shall not affect their interpretation.

AGREEMENT TO TERMS

Upon making a Reservation with Caya Shobo, you accept on your behalf and all those named on your Reservation, to be bound by these Terms and Conditions, including the Reservations and Payments Terms, Medical Terms, Assumption of Risk, and Release of Liability described below. If you don’t agree with (or cannot comply with) these Terms and Conditions, then you may not make a Reservation or participate in our Services.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason, and you waive any right to receive specific notice of each such change. 

RESERVATIONS AND PAYMENTS

Upon making a Reservation or a payment to participate in our Services, you agree to be bound by our Reservations and Payments Terms, which form part of this Terms and Conditions agreement. Please read them carefully.

You can make a Reservation to participate in our Services by booking online at our website: cayashobo.com or by sending an email to team@cayashobo.com. Please share your contact information, and the name of the Service in which you wish to participate.

CANCELLATION, CHANGES OR POSTPONEMENT BY US

 Caya Shobo reserves the right to alter or cancel any Service, any related activity, any facility accommodation or any advertised program team member or service provider, at any time for any reason determined at our sole discretion. 

In the case that we cancel a Service, refund of payments received for undelivered portions of your Reservation shall constitute full and final settlement and release of all claims against us. In the event of cancellation, Caya Shobo is not responsible for any loss incurred due to non-refundable or non-transferable air tickets or other travel costs. 

Compensation will not be paid in the event we are forced to cancel or in any way change a Service due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, pandemic, natural or nuclear disaster, fire, adverse weather, technical or maintenance problems with transport, or other circumstances which amount to force majeure.

THE CENTER and CONDUCT 

You will be allocated a room or tambo for your own private accommodation during your stay, according to your Reservation choice, and on a first-come, first-served basis. Please note we do not usually accommodate room sharing requests. 

We are dedicated to ensuring a safe and peaceful environment for all our guests.  You agree to follow The Center policies which include noise restriction, public access, care of the property and facilities, privacy and consideration of other Caya Shobo guests, staff and representatives. Any consumption of alcohol or recreational substances including e-cigarettes, or any offensive, noisy, aggressive, dangerous, illegal, repeatedly disruptive, immoral or improper behavior will not be permitted during our Services. Offensive or improper behaviour includes any sexual harassment, sexual provocation or sexual verbal / non-verbal insinuation towards any other guest or any Caya Shobo Representative.

Caya Shobo reserves the right at its sole discretion to terminate your use of The Center or any of its facilities in the event of any breach of these Terms and Conditions, in which case you will be required to vacate The Center and you will be excluded from continued participation in our Services, and Caya Shobo shall not refund payment or accept any consequential liability damages or loss.

We kindly ask you to treat The Center and its facilities with care and respect. We also recognise that accidents can occur despite best intentions, and we ask that any damage or loss caused to The Center or its fixtures, fittings, or articles, be reported to us promptly and you agree to pay in full for any necessary repairs or replacements.

Caya Shobo cannot accept any responsibility for loss or damage of personal possessions or valuables of the Customer. Upon check-in, all valuable items may be placed in the Caya Shobo safe at the Customer’s discretion. Please limit your valuables, as traveling with such valuables will be your complete responsibility.

MEDICAL TERMS

We take your health and safety very seriously. Upon making a Reservation or a payment to participate in our Services, you agree to be bound by our Medical Terms, which form part of this Terms and Conditions agreement. Please read them carefully. 

We strongly recommend you have full travel insurance and health insurance coverage for the duration of your participation in Caya Shobo Services or related activities.

We always work closely with customers and staff to provide updates of changing precautions as appropriate.

PARTICIPATION and CONFIDENTIALITY

We want to create a safe and secure environment for all participants in our Services, and to ensure that you feel comfortable sharing personal experiences and information.

You acknowledge that you understand it is likely that other participants will share sensitive personal information during our Services and you agree to keep confidential all personal information shared in any discussion during your participation in our Services. This agreement means that you may not discuss any information shared or the reactions of any member of your Retreat group or Support Service group, including other guests and Caya Shobo Representatives, with anyone outside of the group.

 When you disclose confidential personal information to us, we agree not to communicate or disclose it, or use it for our own purposes without your consent. You acknowledge that this obligation shall not apply where it is necessary for us to disclose information in connection with legal proceedings, to allow us to obtain legal advice, where we have been directed to do so by a court or other body of equivalent jurisdiction, or where we reasonably believe you are at risk of danger to yourself or others.

You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of email, text, phone, Zoom and other technology.

 

PHOTO, VIDEO AND AUDIO RECORDINGS

You agree not to make any photo, video or audio recordings of the ceremonies, discussion groups or other activities without first obtaining our express permission. We do not permit recordings to be made of our ceremonies. You understand that other participants in our Services or Caya Shobo Representatives may not wish to have their picture taken or be recorded, and you agree not to make any photo, video or audio recording of other guests without obtaining their express permission. 

We are committed to creating special memories for you during your retreat. This includes having an occasional on-site photographer and/or videographer to capture special moments. If you are not comfortable with having your picture taken or being recorded, you agree to let us know as soon as possible during your Retreat, or before your participation in our Services. Otherwise you authorize Caya Shobo to use any and all photos, videos or audio content for social media and marketing purposes. Please feel free to contact us should you have any questions about this.

INTELLECTUAL PROPERTY AND DATA PROTECTION

When you participate in our Services you may have access to materials, resources, information, songs, and other proprietary content (“Content”), including (but not limited to) the contents of the workshops and activities which take place during our Services. 

You accept that we are the owner or licensee of all intellectual property rights and any other rights existing in the Content, and that the Content can only be used for your personal use during your participation in our Services, or in connection with the purposes intended by these Terms and Conditions. You agree that no part of the Content should be recorded, copied, shared, disclosed, reproduced, published or made available to a third party whether or not for commercial reasons without our express consent. 

COPYRIGHT AND USE OF WEBSITE

Please see our Website Terms of Use which you agree to be bound by when using our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

COMPLAINTS AND DISPUTES

If you have a problem during your participation in one of our Retreats or Services, please inform a member of our team immediately, who will endeavor to address your concern. You agree to assume an attitude of good faith and fair dealing when considering possible resolutions to your concern as proposed by our Caya Shobo Representatives, and you agree to make best efforts to do this while you are still at The Center or before scheduled completion of your participation in the Service.  You agree not to discuss your complaint with any of our other customers.

If your complaint cannot be resolved during your participation in a Service, you must advise us in writing as soon as possible thereafter.

ASSUMPTION OF RISK, RELEASE OF LIABILITY 

You acknowledge that you choose to participate in Caya Shobo’s Services as a result of your own research and interest and that your participation is entirely voluntary. 

It is strongly recommended that you have the proper personal and health insurance to cover your needs while present at Caya Shobo, in case of any loss of property, illness, injury or death.

By agreeing to these Terms and Conditions you acknowledge that you have voluntarily applied to participate in a Retreat or Service provided by Caya Shobo SAC, a Peruvian corporation. You understand that you may be traveling to a foreign country and that you will participate in various activities. You are prepared to assume the risks associated with this travel, including: forces of nature, terrorism, civil unrest, war, accidents, personal injury and similar circumstances.

You agree that Caya Shobo shall not be liable for any failures beyond its control. This covers natural disasters, war, ‘acts of God’, closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors.

Subject to the Medical Terms which form part of this agreement, you agree to comply fully with any and all health and safety regulations introduced by Caya Shobo, including dietary and medication guidelines and abstinence from recreational substances. 

Upon making a reservation to participate in a Retreat, you acknowledge that you are medically, psychologically and physically fit and able to stay at The Center and participate in the Retreat and the related activities. Upon making a reservation to participate in one of our other Services, you acknowledge that you are medically, psychologically and physically fit and able to participate in the purchased Service.

You understand that the Support Services operate in an unregulated industry and that Caya Shobo is not licensed by any state or nation to provide such services. You also understand that for all legal purposes, the Support Services will be considered to be provided in the Jurisdiction of the country of Peru.

You understand that in your dealings with us, our Caya Shobo Representatives may describe and give information about potential benefits of our Services, but you accept that Caya Shobo makes no claim or promises about the curing of illness of any kind, or about the nature of any spiritual or energetic experience which you understand is entirely personal. You understand that to the extent that discussions or guidance given before, during or after your participation in our Services involve health, well-being, spirituality, relationships, career or business, Caya Shobo Representatives are not promising outcomes, included, but not limited to, improving health, achieving success in life, relationships or business, or achieving certain states of consciousness or spirituality.

You agree to take full responsibility for your own actions, safety and welfare, including unanticipated events, injury, physical or psychological illness, emotional trauma, moral injury or death. You acknowledge that you understand that ingestion of plant preparations, including ayahuasca, carries risk of injury or death. You acknowledge that during your participation in any Caya Shobo Service you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any forms of actions, causes of action, debts, accounts, bonds, contracts, claims and demands against Caya Shobo SAC, a Peruvian corporation, its agents, contractor’s, employee’s, directors or any Caya Shobo Representative, arising from any loss or damage to any person or property that occurs during your participation in a Caya Shobo Service up to and including death, regardless of whether such damage, loss, or injury was caused solely or partly by the negligence of Caya Shobo or a Caya Shobo Representative. This agreement shall bind your heirs, executors, personal representatives, successors, assigns, and agents.

JURISDICTION

These terms and conditions shall be governed by Peruvian Law and you consent to the exclusive jurisdiction of the Peruvian courts in all matters regarding them. 

Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision. These Terms and Conditions operate to the fullest extent permissible by the law. We may assign any or all of our rights and obligations to others at any time.  If any provision or part of a provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and Conditions  and does not affect the validity and enforceability of any remaining provisions.
